Terms and Conditions

These Terms and Conditions apply to bookings made with Mālā Sail Charters ("we", "us", "our"). By making an enquiry or booking, you ("you", "the client") agree to be bound by these terms.

1. Booking process

1.1. You enquire via our contact form, WhatsApp or email. We confirm availability, proposed dates and the total price (including any extras).

1.2. To confirm your booking, you pay a non-refundable deposit as stated in your booking confirmation. The booking is only confirmed once the deposit has been received and we have sent you written confirmation.

1.3. The balance is due by the date specified in your booking confirmation (usually at least 60 days before departure). If the balance is not received by that date, we may treat the booking as cancelled and keep the deposit.

2. Prices

2.1. Prices are quoted in EUR and are "from" prices unless stated otherwise. They may vary depending on dates, cabin occupancy (double or single occupancy), season, number of guests, exchange rates or third-party costs.

2.2. Any extras agreed (skipper, hostess, provisions, transfers, mooring fees, fuel, etc.) will be listed clearly in your booking confirmation and added to the final balance.

2.3. We reserve the right to correct obvious pricing errors.

3. Cancellation and refunds

3.1. If you cancel more than 60 days before departure, the deposit will be refunded in full, except for any bank transfer fees or costs already paid to third parties that cannot be recovered.

3.2. If you cancel 60 days or less before departure, the deposit is non-refundable.

3.3. If you cancel within 30 days of departure, you will be liable for the full amount of the charter, unless we are able to re-sell the charter dates. If we successfully re-sell the dates, we will refund any amount received above the non-recoverable costs, at our discretion.

3.4. All cancellation requests must be made in writing to malasailcharters@gmail.com.

4. Changes and cancellation by us

4.1. If, due to force majeure (including but not limited to weather, strikes, port closures, mechanical failure, illness, safety concerns or travel restrictions), we must cancel or change your booking, we will offer you the choice of a suitable alternative, a credit towards a future date, or a refund of payments made for the cancelled part.

4.2. Where the charter is provided by a third-party partner (e.g., bareboat with an independent charter company), their specific terms and cancellation policy may also apply, as set out in their charter agreement.

5. Insurance, safety and requirements

5.1. Adequate travel insurance is strongly recommended (including cancellation, curtailment, medical, personal liability and, if applicable, water sports cover).

5.2. You must follow the instructions of the skipper/crew and all safety rules at all times. We reserve the right to end the charter early without refund if your behaviour endangers the vessel, crew or others.

5.3. For bareboat charters, you must meet the licence and experience requirements of the charter company, and the terms of their charter agreement will apply.

6. Liability

6.1. Mālā Sail Charters acts as a broker/organiser in some cases and as an operator in others. Where the vessel is operated by a third party, their liability applies.

6.2. We are not liable for loss, damage, injury or delays beyond our reasonable control.

6.3. Our maximum liability for any claim arising from your booking will be limited to the amount you paid to us for that booking.

7. Complaints

If you have a complaint during the charter, you must report it to the skipper/host on board immediately so we can try to resolve it. If not resolved on board, please email us within 7 days of the end of your charter at malasailcharters@gmail.com.

8. Data protection

We process your personal data as described in our Privacy Policy.

9. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute shall be subject to the jurisdiction of the courts of Spain, unless otherwise required by law.
